The United States provides jobs to thousands of workers from all over the world every year. The worker included in this list have along line just as investors, scientists, artists, researchers, information technology specialists, agricultural workers. The workers from all categories enter in the USA through legal permission. The USA shows remarkable growth in economy and due to this country need skilled workers. There are various employers in the United States who hire the skilled workers and labour from all over the world on temporary basis. The USA economy is growing with the passage of time and due to tight labour market the employers are going to hire workers from all over the world on temporary work visa. It is also in considered that it must not disturb the wages of the local workers and the visa will be purely on temporary basis. The Immigration Act has some room for non immigrants on temporary basis. There are three main visas are used for this purpose the H-1B visa is for occupation specialist and the H-2A is applied for purely temporary workers or used for agriculture workers. However, the H-2B is often used for temporary seasonal non agricultural workers. The one unique feature among these visas are that they are temporary basis.
H-1B Visa Requirements
This visa is considered in non immigrant visa category for foreigner who visit the USA for temporary jobs. The jobs offer to these non immigrants need speciality and experience in occupation. Moreover, the foreigner have a bachelor’s or higher degree or has an experience, which is equal to bachelor’s degree. The visa validity is three years, but it can be renewed for another three years while it permits maximum six years stay in the US. The foreign workers’ family members like spouse and unmarried children under 21 years old can stay with them. However, they cannot work there without a separate works visa. The foreign worker is able to stay and support family member who accompany him in the visa validity period during the stay in the USA. Although H-1B visas were fixed in number like 65,000 per year, but due to need and demand of the USA economy it may increase. This number also increase due to tight labour market in the States. In case of hiring H-1B workers living outside the U.S, the employer placed an application to the Department of Labour and fulfil other requirements in this regard. The employer files all necessary documents and agreement between employer and employee. After getting this visa, the employee cannot change his job until new petition is filed by new employer. If an employee is terminated by employer before the agreement period then the employer will mange the return expenses.
H-2 Visa Requirements
There are two main division of H-2 visas, the H-2A and the H-2B. In the H-2A category the foreigner visit the USA on temporary or seasonal agricultural employment and worker will engage in agriculture related jobs. This visa is issued to fulfill the demand of agriculture workers while the H-2B classification visa is for workers who engage in non-agricultural jobs. These jobs are also for seasonal requirement or at the time when working load in extreme position just as in ski instructors and chefs who perform duties at ski hotels and resort in winter. The employer’s apply for a temporary labor certification. This certificate ensures that the entry of this worker will be temporary and the employer admit that he will provide wages, housing, meals, transportation and other benefits. Getting certification then employer files a non immigrant-worker petition. H-2A workers are allowed for fixed time while this time is not exceeded to one year. Similarly the employer hire H-2B workers through labor certification that there is no availability of local workers and will provide standard wages and working conditions. The time is also fixed in this category and cannot extend more than one year. If the employer terminate an H-2B worker, then he will bear all return expenditure of this employee.

2. On ine Form DS-160, Non immigrant Visa Electronic Application.
3. A valid passport and validity must be at least six months.
4. One 2×2 photograph.
5. Temporary worker visa fees paid receipt.
